ELK GROVE, Calif. —
An unlawful camping ordinance went into effect this week in the city of Elk Grove, just months after the city created an Affordable Housing Committee (ad hoc) which focuses on discussing issues related to homelessness.

The city council cites that unlawful camping in the city has "created public health and safety problems."

According to District 3 Councilmember Kevin Spease, several counts have found that there are anywhere between 45 to 150 individuals experiencing homelessness in the city.

Prohibitions under the new ordinance

Camping within 500 feet of day care centers, schools, playgrounds, or youth centers.

Occupying a camping area greater than 150 square feet measured from the center of the primary living area of the total camping area.

Occupying any encampment.

Fail to keep camping areas clean and free of garbage, debris, and waste, including hazardous waste and/or human waste.

Camping in structures that an authorized city official finds unsafe for human occupation.

Ordinance violators will first be notified about services for temporary or permanent housing, then will receive a written notice, and finally, their property could be temporarily confiscated.

Owners can claim their seized possessions within a 90-day period unless a city official determines it presents a health or safety hazard.

As unhoused Elk Grove residents are left wondering what this means, city officials say that this measure aims to help them transition out of homelessness.

"This is not going to be a crackdown straight out of the gate, there's going to be a lot of education at the front end, a lot of dialogue," said Pat Hume, District 2 council member.

Crystal Shetka and Sharon Fine, who share an encampment area, say that although they've been forced to move locations in the past, they haven't been offered resources.

"I can understand that because there are kids, but where do they expect us to go? I mean, we don't have anywhere to go, obviously, that's why we're out here," Fine said.

"Being homeless isn't a crime. It shouldn't be, at least," Shetka said.

A previous draft of the measure would have included a $100 fine for violators, but District 2 Councilmember Kevin Spease told KCRA 3 that "stacking [homeless individuals] with $100 fines just makes it more difficult for those organizations that are trying to get into [affordable] homes."

The fine was removed from the final ordinance.
