In less than a month, voting centers across Sacramento County will open for people to begin casting ballots in-person in the California gubernatorial recall election.

Vote-by-mail ballots on Monday started to show up in peoples' mailboxes. However, some other, more questionable types of ballots might also have been sent.

A KCRA 3 viewer recently contacted us concerned about fraud after getting two voter registration cards in the mail. One card was addressed to "Ben K Legit" and says the voter was registered in June to the "Common Sense Party." Another addressed to "Rick C Clutch" shows another June registration date, but with no party affiliation.

"My wife and I are registered to vote and have lived here for 5 years," the viewer said through email. "We are worried about our security and California elections fraud."

KCRA 3 took the concerns directly to the Sacramento County spokeswoman for voter registration and elections, Janna Haynes.

What is the system in place to update the voter registration record?

The county has an active and inactive voter list. A voter is considered active if they are registered and have voted within the last four years, Haynes said.

One goes on the inactive voter registration file until they contact the county and re-up their registration to be put back on the active list. If someone is on the inactive list, they will not get a ballot in the mail.

With any election, 15 days before election day is the deadline to register to vote in order to get a ballot in the mail. For the gubernatorial recall, Aug. 31 is the last day to register to vote either online or in-person at the registrar's office.

Is there ever a circumstance where names are removed from a voter list?

"If they have been registered and do not update their registration, for instance, if they move out of state or we do not receive a death certificate for them, they’ll remain on the inactive list," Haynes said. "But for our purposes, they are more or less as good as not registered because they do not receive a ballot from us when we mail out our ballots."

"When we say we have 868,567 registered voters right now, that is not inclusive of any inactive voters," according to Haynes.

"There are times where we will go through the list and try to reconcile it with Vote Cal, which is the system that the DMV uses to transmit information from us. We will reconcile it with any death certificates that we have. That’s done on a regular basis but if we do not have any change of information from them. We don’t scrub them completely from our records as if they never existed. They simply go on the inactive list to where they no longer receive the ballot information from us and then it’s on them to re-up themselves into the system as an active voter so that they can receive ballot information at the next election," she said.

"We do voter file maintenance on a daily basis. As returned ballots/correspondence come back with new addresses that are in-county, we send these voters new VNC cards, and out-of-county addresses are pushed to the new county, and out of state addresses are placed in the inactive file and a change of address card is sent to them to confirm their address," she said.

It does happen. There are a few different reasons why that can happen.

"It’s possible that one of those people did live there at some point and have since become inactive, which is why they’re asking them to renew their registration," Haynes said.

"More likely though it’s possible that they live in a similar area and the numbers on their home address were transposed and the cards were sent there in error based on a data entry error or a voter entry error when they register to vote or changed their address," she added.

"It’s so hard to know. People have all kinds of different names. They may have changed their legal name at some point. There’s really no way to know if those names are real voters," Haynes said.

"If someone has suggested that as their legal name then that’s what we have. "What we need people to really focus on is that we need your participation to update our voter registration files. We can only do so much. If people move and they never do anything, they don’t get a new ID, they don’t go in and actively change their registration, how can we ever possibly know that they do not live at that address anymore?"

What if someone gets a card like the KCRA 3 viewer did and already has a registration in their name. Can that person vote twice?

Haynes said it’s not clear if those two individuals would even receive a ballot. They may be on an inactive list.

"It’s very unlikely that the signature would match in which case we would reach out back to those individuals to look at their signature and they would have to resubmit a signature that matches on file."

"It also should be noted that trying to vote either twice or under someone else’s name is a federal offense," Haynes said.

What should voters do if they get cards like this in the mail that is not in their name?
