Santa Clara County extends $0 bail schedule through June 30

SAN JOSE – The Santa Clara County Superior Court is once again extending its $0 bail schedule in an effort to keep local jail populations low amid the coronavirus pandemic.

The Superior Court Bench on Tuesday voted to extend the schedule through at least June 30. It is the third time the schedule has been extended since it was put in place last April.

The schedule applies to all accused persons arrested and in pretrial custody and all accused persons held in pretrial custody. Bail for all misdemeanor and felony offenses must be set at $0 except for specified offenses such as serious and violent felonies. The court, however, retains the discretion to deny bail, to set a higher bail for any offense and to order conditions of release deemed appropriate for any offense.

“Our court shares in our community’s concerns about transmission of the coronavirus,” said Presiding Judge Theodore C. Zayner in a statement announcing the extension.

“We know that groups of people in close confinement increases the potential for transmission, including within the jails and among prisoner populations,” Zayner continued. “While we are pleased to see that there is progress being made to fight against and contain COVID-19, our court has decided that extending the emergency bail schedule is the right course of action at this time to help protect the health of our citizens.”

As of Jan. 18, the date for which data was most recently available, there were 107 active cases among the 2,261 inmates in custody, according to the Santa Clara County Sheriff’s Office. A total of 536 cases have been recorded since the start of the pandemic.
