Video of a traffic stop in Elk Grove involving a Black driver and a white police officer is raising questions in the community.

The incident took place last Sunday, when the driver of a car rolled through a stop sign in front of an Elk Grove police officer.

The officer captured the encounter on dashcam video.

“Pull your vehicle to the right side of the road,” the officer is heard telling the driver.

The driver, Tobias Eagle, a 19-year-old student majoring in mechanical engineering at Sacramento State, said he rolled through the stop sign, but he said was scared of the officer.

“It was very intimidating, especially when she was like posturing up like she was holding her hand on her gun,” Eagle said.

Eagle pulled over in front of his house, where his mother came out and met her son in the driveway. Eagle said he disobeyed the officer’s order to stay in the car because his mother told him to get out of the car.

Adding to the tension was the thin blue line face mask worn by the police officer.

“It was pretty scary,” said Eagle’s mother, Stacey Slocum, who witnessed and recorded the incident. “Because when the officer stepped out, she had this Blue Lives Matter covering on. We're African American, as you can see. And you know, it's a direct clap-back to Black Lives Matter."

The Elk Grove Police Department said the face covering was unauthorized and in a statement wrote, “one of our core responsibilities is to project neutrality and pay deference to others’ perspectives. In this instance we fell short of this responsibility.”

Tobias Eagle’s family is also taking issue with another part of the interaction.

“I need to know if you're on probation or parole and that's the only question,” the officer, identified as Misty Johnson, is heard saying on her body cam video.

Eagle said he is not on probation or parole.

In the Facebook Live video, Slocum said Johnson was refusing to give Eagle his ticket for rolling through the stop sign. She also pointed out that Johnson kept her hand on her gun.

"Give him the ticket," Slocum says in the video. "My son will not be another one of y'all hashtags."

Eagle said his interaction with the Elk Grove officer was very different compared to Mohamed Esmail, who said he was cited by the same officer two days later for running the same stop sign.

“When I got pulled over, she was super nice. I didn’t feel afraid or in any sort of harm whatsoever,” Esmail said.

In response to the Esmail incident, Elk Grove police spokesperson Hannah Gray said, "Our officers make numerous traffic stops every week and the circumstances are unique. Our officers must adapt to every situation."

Elk Grove police asked for an independent third party to investigate the incident involving Tobias Eagle, but they have not yet identified which agency might be involved.

“To be transparent in our community we have initiated a review of the incident,” said Elk Grove Assistant Police Chief Bobby Davis.

Eagle and his family have filed a complaint with the city about the incident.
