The city of Sacramento reached a $99,000 settlement with a man after a police officer shot at his dog, the man's attorney said Tuesday.

The shooting happened in December 2019 outside the Safeway on 19th Street. Kevin Cole, his dog and a security guard were injured by bullet fragments.

Cole filed a federal lawsuit in March 2020 against the city that listed 15 claims, including false detention/arrest, retaliation, unreasonable and excessive force, assault/battery and negligence.

On Dec. 18, 2019, Cole was sitting outside the Safeway with his dog when the security guard told him to move along. According to the lawsuit, Cole told the guard was going to the Panda Express but the guard told him he couldn't go into the restaurant and had to leave immediately if he didn't want police to be called.

Sacramento police were then called to the scene, and an officer asked Cole to leave.

After about five minutes, officers began trying to detain Cole, and his dog, Nikki, began barking at the officers. In body camera video released about 10 days after the shooting, Cole can be heard telling Nikki to sit.

During the struggle, Nikki bit one of the officers and then lunged at another officer, who fired their gun.

The bullet struck the ground and fragmented, hitting Cole between the eyes, Nikki in the leg and the security guard in the leg.

Cole’s attorney Mark Merin said Cole had to undergo two surgeries and is blinded in one eye.

Nikki was treated and returned to Cole. Cole was not charged with a crime.

The lawsuit was against the city and the police department. The settlement agreement was made on Sept. 9.

Merin said Tuesday the shooting was "unnecessary use of force” by Sacramento police.
